Senate to remove Presidential power tampering tariff rates

A joint resolution seeking to terminate the delegated authority of the President to adjust tariff rates on rice has been filed in the Senate. Hontiveros and Pangilinan argued that the power to impose tariffs fundamentally rests with Congress, pursuant to Article VI, Section 28(2) of the Philippine Constitution. “While the President is granted delegated authority to adjust tariffs under Section 1608 of Republic Act No. 10863, otherwise known as the Customs Modernization and Tariff Act (CMTA) of 2016, this is not an absolute power. Section 1608(f) of the CMTA explicitly provides the remedy: The power herein delegated may be withdrawn or terminated by Congress through a joint resolution,” they said.
